Recent Changes in the Law
Kansas recently made many changes to it's workers' compensation law, which came into effect on July 1, 2011. Like Missouri, Kansas now uses the term "prevailing factor" in establishing the extent of the injury. This effectively means that pre-existing injuries cannot be a major factor in establishing the cause of the new injury. These changes were prompted by the insurance industry and effectively make it more difficult for injured workers to prove their claim. In some instances, it can even cost someone his or her claim.
